The New AZ HOA Homeowners' Freedom of Speech Senate Bill HB2158 and How Our Board Reacted To It
INTERESTING TIMELINE of SENATE BILL #HB-2158 and our Board of Director's reaction
This Bill gave more rights to HOA Homeowners' freedom of speech.
Sept 24, 2022 – HB-2158 Went into effect by law.
Sept 28, 2022 – A false police report filed against a resident by GM stating she was building an armed militia in her home. This resident has been a main target for speaking up.
Oct 20, 2022 - Dennis Legere held a lecture about HB-2158 @ the Western Nat'l. Parks Assoc. for SCOV, (3) Board Members were present. Dennis offered his assistance to the Board Members (but they never cared to work with him).
Oct 20, 2022 - Eight Cease and Desist letters were sent to residents stating they 'MAY' have engaged in online public forums in a defamatory manner. Intimidation.
Oct 25, 2022 - COM-005 - A board policy regulating resident use of the private HOA facebook group was created and passed by the Board. This was to remove all ‘negative’ comments which was all comments they did not like. They also banned people from facebook.
Dec 8, 2022 - BOD-034 - A board policy for resident Code of Conduct rules was created. It was a guideline in a handbook before this.
March 15, 2023 – Residents starting holding homeowner meetings in the AC meeting rooms to discuss issues. A request for new cameras was made by GM Wade. The board voted against audio but they were installed anyway! This was discovered by asking the installer if the cameras had audio. How could that have happened? They were ordered and installed even though it was illegal to do so? It was costly to remove & replace them & we are not sure they even really took them out.
NOTE: Many policies were created or revised in 2022, 2023, 2024 during the excessive spending. Board Policies written were designed to silence and punish residents who question things. Board policies give the board power and these policies do not require a community vote.
