Info on the Copper Health Purchase, its Vote and its Pending Lawsuit

Copper Health & Financial Concerns


Caring Homeowners believe that the vote to purchase the Copper Health (CH) building was based on inaccurate information.

Beware of possible future financial concerns!


~ CH vote documents, videos and emails told us that due to needing extra space for the Artisan Center and Hard Courts, and that the Welcome Center (WC) was in need of razing because it was built as 'modular trailers with problems' - we all should VOTE for the CH purchase. We paid $4.5+ million dollars for the building, above even the asking price. And, millions are still needed for renovations to the building. The information used to promote the vote to buy the building, was based on erroneous information. * Document proof available.


~ One engineering report on the WC, of limited nature from Nov 2021 (pre-vote) found no serious problems. A May 2023 engineering report also found no structural problems and implied that the WC was not 'modular' after all. This throws into question the ‘facts’ that we voted on: they were incorrect. * Document proof available.


~ Sincere questions and financial concerns for buying, renovating, and maintaining an additional building (the CH @ 22,660 sq. ft. plus the WC @11,000 sq. ft. we are now keeping intact) could end up costing us millions MORE than we originally thought.


~ There are worries about our finances for replacing the $2 million in the Capital Fund (within a 5 to 6 year projection) and concerns that our Asset Reserve Fund for fixing items over $1000 is not being funded well enough. Considering the renovations that will be needed to accommodate the plan to move a few clubs and maybe the loan room, costume room, etc., costs could be great.


~ Our needs for space may be approx. 6,000 to 8,000 sq. ft., (estimated at this moment per the Copper Center Task Force meetings) - yet we are committed at this time to filling 22,660 sq. ft. at this new building. Yes, the extra space could be utilized and filled, but is the addition of this new CH building necessary, affordable and sustainable?


~ Our governing documents allow boards to approve up to a 15% increase in HOA Dues and charge Assessments based on 5% of our yearly gross revenues in addition to the ‘standard 5%' that appears to be planned every year. No decision has been made; this board has not suggested these increases. Future boards however may make such decisions if our financial health dictates it.


~ There is a lawsuit against us. Though we didn’t receive timely and accurate information previously, we know it is not frivolous (previous boards told us this) and could be serious. We might win, but we might lose. Concerns exist that if we are found liable and must pay what the plaintiff asks (lose of revenue, punitive damages and attorney fees) this could be another drain on our finances. Can we sustain that without dues and fee increases?


~ Mediation is scheduled for December 12, 2023 and a trial is set for April 25, 2024.


We are 'Caring Homeowners' who have dedicated hours of hard work and research on these matters. We have much official documentation to support what we say.


We ask for NO alterations to CH until after the lawsuit is settled.

We ask for better due diligence with seeking the facts

for informed decision-making by Leadership.
